What N.C.G.S. 20-137.4A Actually Prohibits

It doesn’t reach a name or number already stored in your phone, caller identification information, or voice calls for drivers over 18. North Carolina hasn’t enacted a comprehensive hands-free law, so adult drivers can still make and receive voice calls while driving. The prohibition targets manual texting and message-reading specifically.

Several activities are also expressly exempt: drivers who are lawfully parked or stopped, law enforcement, fire, and ambulance personnel performing official duties, and drivers using GPS navigation or voice-operated technology. Because the officer must show you were manually texting or reading a message rather than doing something the statute doesn’t cover, factual disputes in these cases are more common than people expect.

Penalties by Driver Type

What you face depends on who you are:

• Adult drivers (18 and over): A civil infraction with a $100 fine plus court costs. The statute specifies that no driver’s license points and no insurance surcharge attach to a conviction under this section.
• Drivers under 18: A separate, broader restriction under G.S. 20-137.3 applies, with exceptions for emergencies or contacting a parent, guardian, or spouse. The fine is $25.
• School bus drivers: A violation is a Class 2 misdemeanor, a criminal conviction rather than an infraction, carrying a minimum $100 fine.
• Commercial motor vehicle drivers: Subject to a separate federal prohibition tied to Parts 390 and 392 of Title 49 of the Code of Federal Regulations, with consequences that can extend well beyond a state-court fine.

Why a $100 Fine Is Still Worth a Second Look

The dollar amount is low, but that doesn’t make the citation automatically unwinnable or automatically harmless. Depending on the circumstances of the stop, cell phone use while driving can accompany or lead to a reckless driving charge, which carries criminal consequences. The evidentiary question matters too: an officer observing a driver from outside a moving vehicle can’t always tell whether someone was manually texting, using GPS, or doing nothing prohibited at all.
